The Food Standards Agency of the UK issued yesterday, 25th January 2010, a Food Alert in respect of 2 batches of Divine's 70% Dark Chocolate 100g bars - batch numbers L129045 and L329411.
These two batches were only available at UK supermarkets, specifically Tesco, Sainsbury’s, Morrisons and Waitrose. Tesco may also have supplied stores in the Republic of Ireland.
The Food Alert draws attention to the public that these batches may contain milk in quantities which may be of concern to those allergic or intolerant to milk. Tests by the FSA indicated that a recent batch contained 0.7% lactose and greater than 256mg/kg of casein. The FSA has concern that these levels may present a public health risk to those allergic or intolerant to milk or lactose.
The bar contains a label with the warning "may contain traces of milk". The FSA believes that such labels suggest a lower content than that found in their laboratory tests.
Divine has received only one complaint concerning lactose in its 10 years in production. The FSA acknowledges that no reports of ill health have been made with regards the 70% Dark Chocolate.
Action taken and to be taken by Divine
Divine takes its responsibility for health and safety very seriously.
Milk and lactose are not listed as ingredients in 70% Dark Chocolate but trace elements do exist in the manufacturing process. Divine has discussed the reduction and potential elimination of the trace elements of milk and lactose in 70% Dark Chocolate with its manufacturers since this issue was drawn to its attention.
Divine has voluntarily withdrawn these two batches of 70% Dark Chocolate from sale.
The FSA has not requested a recall of the two batches. The FSA says that no other Divine Chocolate products are affected.
Supplies to other countries including the USA are not affected.
